GUARDIANSHIP LIKE A FORM OF ADOPTION OF CHILDREN WITHOUT PARENTAL CARE: DISCUSSABLE QUESTIONS

The article examines relations in the sphere of guardianship regulated by the Civil code of the Russian Federation, Family Code of the Russian Federation and the Federal law «On guardianship». The author comes to the conclusion that the relations in the sphere of guardianship have interdisciplinary nature. And this this interdisciplinary institution reveals most clearly traces of two groups of social relations based on civil law and family law. A particular attention is paid to consideration and interpretation of evaluation categories, to analysis of judicial practice. This study allows coming to conclusion that the only way to reduce this problem is to change the state policy in whole towards the family, take measures to support families, promotion of family values, protection of families and children, including from the tyranny of the state.
