ON THE SPECIAL SUBJECT OF PROFESSIONAL PROTECTION OF A MINOR SUSPECT AND ACCUSED IN THE CRIMINAL PROCEEDINGS OF THE RUSSIAN FEDERATION

The article discusses the main elements of the professional protection of a minor suspected and accused, which are the set of special features that form a specific objective complex in this type of human rights protection. In addition to the legal, attention is focused on the socio‑psychological components of realization of the right of minors to protection. The ratio of activities of a lawyer‑defender with the legitimate interests of a minor client established by the legislation of the Russian Federation and social requirements is analyzed. Based on the results obtained, specific measures are proposed in the field of protection of a minor suspected and accused of criminal proceedings. The basis for the study was the scientific hypothesis that the provision and implementation of the right for defense of the minors involved in the criminal process as criminally prosecuted persons has certain specifics that require consideration and application. The problem of legal regulation on the topic of research is that the rules of criminal proceedings for juveniles established in the Code of Criminal Procedure of the Russian Federation primarily take into account the interests of the bodies conducting the process. Meanwhile, the legal concept dictated by the international acts on providing juvenile suspected and accused with enhanced legal protection should offer real, not formal means and methods of protection. Given these aspects, this article is a scientific study on the possibility of updating the mechanism regulating the right for protection and of interest from the point of view of both theoretical and practical description of protection of the minors involved as suspected or accused persons in the criminal proceedings.
