TYPES OF CRIMES AGAINST JUSTICE COMMITTED BY OFFICIALS OF PRELIMINARY INVESTIGATION BODIES

Annotation:

The article analyzes the types of crimes against justice committed by officials of the preliminary investigation bodies, examines the general features characteristic for this group of crimes. It was revealed that the encroachment on the interests of justice committed by law enforcement officers carrying out the preliminary investigation poses a great public danger, this is due to the fact that the actions of the relevant officials violate the principles of legality and fairness of criminal proceedings, and also cause significant harm to its participants. In addition, it was noted that the commission of crimes against justice in the vast majority of cases remains latent. It was revealed that falsification of evidence in criminal cases and falsification of procedural documents are the most frequent in the field of crimes against justice committed by officials of the preliminary investigation bodies. Also, the article pays attention to the issue of considering criminal cases in a special order, that is, without examining evidence, which limits the ability to identify falsification of evidence. It is emphasized that the analyzed crimes are often committed on the basis of falsely understood interests of the service, out of selfish interest, and may be directly associated with actions of a corrupt nature. It is noted that the systematic and scientifically grounded classification of crimes against justice helps not only to analyze the urgent problems of this category of crimes in their interrelation and interdependence, but also to correctly identify priorities and make practical decisions. Consideration of the types of the investigated group of crimes cannot be an end in itself; it should serve to identify essential relationships in the system of crimes against justice and a comprehensive study of methods and ways to prevent them.
