The article explores the understanding and place of forensic strategy in science. For a long period of time, they have been the subject of wide discussion among forensic scientists, whose opinions often seem to be radically different. The scientific development of the category of “forensic strategy” is directly linked to the problems of broadening the subject matter of forensics and clarifying its structure, which necessitates a detailed understanding of it. The author studies and analyses the views of criminalists on this issue, makes their systematization and scientific analysis. The problem of expanding the subject of forensic science in the development of the considered scientific category is revealed. The conclusion about premature consideration of forensic strategy as a new section in the system of criminalistics in view of the lack of objective and subjective prerequisites for this is justified. The author comes to the conclusion that such a system transformation should be a progressive, natural process in its development and cannot be spontaneous. It is concluded that it is necessary to understand the forensic strategy at the present time in a narrow sense as a structural element of private forensic techniques, which seems correct from the point of view of conceptual views on the structure of the forensic system. The article emphasizes that the forensic strategy in the narrow sense can’t be reduced exclusively to forecasting and should use the possibilities of other forensic theories and organizational exercises. A proposal is made for the further development of this scientific category, depending on the subject of the criminal process, the category of the crime, the variety of the procedure of the proceedings in the case. |
