The article substantiates the stages of improving legislation, draws conclusions about the absence of the concept of economic evaluation of a normative legal act in Russia and other states until the beginning of the 19th century. Particular attention is paid to the structural analysis of the development of jurisprudence as a science in the Russian state, the role of codification as an important element in eliminating problem areas in legislation, the causes of contradictions in legal norms at the present stage, the process of forming law-making theories, introducing concepts, essence and stages of the law-making process into science, studying the reasons for the appearance of legal gaps in the legislation and their elimination. The concept of “the effectiveness of the law”, which appeared in the early 2000s, is disclosed and the problems of inefficient rule-making activities are considered. The necessity of creating conditions that encourage lawyers to eliminate defects in legal acts in the pre-codification, codification and modern stages of improving legislation is substantiated. New views on the development of legislation appeared in the process of completing the codification stage, which ensured the identification and elimination of imperfections in the legislation. In this regard, codification in the 19th century became the main direction for eliminating defects in legal acts. The article discusses the process of formation of law-making theories of the 20th century and reveals their role in the emergence of the concept of “legislative process” and its implementation. Attention is paid to the relationship between rule-making activity and the distribution of economic wealth in the form of finance, which contributes to the actualization of the problem of effective assessment of legal acts. |
