In this paper, the subject of the study is normative legal acts regulating relations in the field of implementation of the best available technologies (BAT) in the energy sector in the countries of the Eurasian Economic Union (EAEU). A comparative analysis of normative legal acts was carried out and a comparison table was compiled of the main provisions on the introduction of the BAT in the EAE states, such as: definition of the concept of BAT; the process of introducing BAT; a list of areas of application of BAT and the procedure for collecting information about BAT; BAT reference books, comprehensive environmental permits, and other methodological documents. A comparative analysis revealed a different level of normative legal regulation in the field of implementation of BAT in the EAEU member states: in some states, basic terms and definitions are established at the level of laws, the procedure for the introduction of BAT is prescribed, a list of areas of application of BAT is defined (the Russian Federation, the Republic of Belarus, the Republic of Kazakhstan), the legislation of others contains general provisions on the need to introduce environmentally friendly technologies in the course of economic activity (Republic of Armenia, Kyrgyz Republic). Based on the analysis, proposals for the harmonization of the legislation of the EAEU states in the field of regulating relations on the implementation of BAT in order to implement common programs and concepts of cooperation in the field of energy and establish similar (comparable) normative legal regulation in this area are substantiated. In particular, it is advisable to consolidate the uniform concept of BAT, as well as establish a unified procedure for the introduction of BAT. It also seems advisable to consolidate at the level of national environmental protection laws the procedure for maintaining the state register of BAT, BAT reference books, databases. |
