ANALYSIS OF THE CRIMINAL LEGISLATION AIMED AGAINST ILLEGAL TURNOVER AND USE OF DRUGS IN THE RUSSIAN FEDERATION

The article has analyzed the gaps of Article 228 and 228.1 the RF Criminal Code, and has proposed the number of changes to the revisions of these articles. The issues arising in the process of classification of illegal manufacturing, processing, storage, transportation of drugs have been reviewed. The amendments to the RF Criminal Code that entered into force on 12 May 2004 concerning the regulation of responsibility for illegal turnover of narcotic drugs and psychotropic substances have been analyzed. Weaknesses of the number of provisions of Plenum of the Supreme Court on June 15, 2006 # 14 “On the court practice in the cases of crimes connected with narcotic drugs, psychotropic and poisonous substances” have been specified The article has commented the issue of distinction between the concepts of manufacturing of narcotic drugs and psychotropic substances (Article 228 of the RF Criminal Code) and their production (Article 228.1 of the RF Criminal Code).
