DISPUTABLE ISSUE OF LEGISLATURES REGULATION, APPLICATION OF A MEASURE OF RESTRICTION SURVEILLANCE DECISION-MAKERS MILITARY POST

On the basis of the analysis of the current legislation the problem of using a specific measure of restraint in the form of the command control has been analyzed. The point of the measure of restraint, its specific features and usage has been detected. A comparative analysis of the current legislation and its practical use have been put into the basis of the methodology. The article analyses such issues as legislative recognition of the entities, imposition of measures of restraint in the form of the command control, the practical realization of this measure and obligations put upon the military base to carry out the measure. Changes in the legislation suggested by the author could solve some (problems) connected with the imposition of the measure and could make it constructive.
