THE ISSUE OF DOCTRINAL PRINCIPLES OF THE ENVIRONMENTAL LAW (ON THE EXAMPLE OF CLIMATE PROTECTION)

The author argues that the norms of climate protection are enshrined in the international legal acts adopted and signed by the Russian Federation. In Russia there is a number of regulations aimed at implementation of provisions of the international agreements; however, there are no relevant rules on protection of the climate in our environmental legislation. There is the experience of several CIS countries, which can be used to fill the gaps in the Russian environmental law. Given that the principles are the core of the legal system (and every law), specifying not only its current state but also fulfilling the prognostic function of its development, it is proposed to supplement the Federal law «On environmental protection» with the new principle of «legal protection of climate», which today is still purely doctrinal in nature.
