Annotation:

One of the large-scale geopolitical changes at the end of the last century is the collapse of the Union of Soviet Socialist Republics and the formation of independent states on its territory. At the same time, the social realities of recent decades are characterized by the intensification of the processes of globalization and international integration. The latter also touched upon the post-Soviet space, on the territory of which a new integrative interstate entity, the Commonwealth of Independent States, was created. The above processes are inherently characterized by an increase in the intensity of international migration. In the sovereign states that emerged in the post-Soviet space, extrajudicial mechanisms for the protection of human rights and freedoms are developing. These include the legal institution of the Ombudsman, to which, if necessary, in order to obtain assistance in the exercise of their rights, external migrants can also apply. Following world experience, some countries of the post-Soviet space took the path of specialization of ombudsmen, creating the posts of ombudsmen who protect the rights of specific social groups, in particular, minors. Minors affected by migration processes are more vulnerable than adult migrants, as they face specific legal problems. For this reason, public structures performing the functions of children’s ombudsmen in the post-Soviet states should pay special attention to resolving the legal problems of children with migration experience. This article analyzes the legislation and law enforcement practice of the CIS member states in terms of the possibilities of ensuring the enforcement of the rights of foreign children by the forces of the ombudsman service, identifies the possibilities of interaction between it and the prosecution authorities of these countries.
