LEGAL PREREQUISITES AND LAW-MAKING INITIATIVES FOR THE CREATION OF A GENETIC DATABASE IN THE RUSSIAN FEDERATION

Annotation:

The article discusses the problems of the current lack of a centralized genetic database in the Russian Federation with appropriate legal regulation of activities related to genetic information. Storage of data obtained by researchers as a result of genome sequencing on unprotected local servers, which may be located also outside the Russian Federation, poses a threat to private and public interests, as well as threats to national security in the current geopolitical situation. Since genome mapping began, the volume of genetic data has increased dramatically and such data is stored primarily for use in research, including genetic diseases. When such databases are combined into a single system, they become more functional as the number of DNA sequences available for searching and analysis increases. However, significant challenges arise in the management and control of these data, including the fact that they contain genetic information about identifiable persons, which requires an appropriate access regime for these databases. Moreover, the ownership not only of the databases themselves but also of the genetic information stored in them remains unresolved. The article analyses the progressive steps taken by the legislator in creating and regulating the activities related to the unified genetic information database. The author formulates proposals for further development of legal regulation of genetic databases in the Russian Federation.
