| Annotation: |
The relevance of this research is determined not
only by the current domestic and foreign policy situation, but
also by the need of the state and society to preserve and develop
spiritual and moral values, including their institutionalization
and legal protection from destructive influences. In the context
of modern challenges and threats associated with the transformation
of social norms, there is a need to analyze how some
spiritual and moral categories are integrated into the criminal
procedure legislation of the Russian Federation.
The object of the study is spiritual and moral values
and their significance for criminal proceedings. The subject
of the research is the analysis of the content of such categories
as the good, welfare, ethics, morality, conscience, honor, dignity
and respect, and their reflection in the norms of the Criminal
Procedure Code of the Russian Federation. The methodological
basis of the research includes a comparative legal analysis
and a detailed study of normative legal acts regulating spiritual
and moral aspects in the framework of criminal proceedings.
Additionally, analytical, system-structural and legal research
methods are used.
The purpose of this study is not only to assess the degree
of compliance of modern criminal procedure legislation
of the Russian Federation with basic spiritual and moral categories,
but also to identify those moral and ethical norms that are reflected in legal acts, as well as to analyze gaps and inconsistencies
in this area. This approach allows not only to evaluate
the effectiveness of existing legal mechanisms, but also to suggest
ways to improve them, taking into account modern realities.
As a result of the conducted research, the author comes to
the conclusions about the existence of a spiritual and moral
matrix on which criminal proceedings are based, about
the incompleteness of reflecting a number of spiritual and
moral
guidelines in the activities of participants in criminal
proceedings and about the need for legislative consolidation
in the norms of the Criminal Procedure Code of the Russian
Federation of such important categories as “conscience”,
“honor”, “dignity”, “mutual respect.” |
