In the modern system of public administration,
the rotation system for state civil servants has been operating
since January 01, 2013, the date of entry into force of Article 601
of Federal Law No. 79-FZ dated July 27, 2004 “On the State
Civil
Service of the Russian Federation”. The last time the institution
of rotation underwent changes was in 2023 due to the introduction
of amendments provided for by Federal Law No. 645-FZ
dated December 29, 2022. The relevance of this work is determined
by the fact that the existing rotation procedure requires
reform in order to effectively achieve the goals of rotation established
by law.
The paper analyzes the normative legal acts regulating
the functioning of the rotation system for state civil servants.
The author analyses the features of the legal regulation
of this institution in relation to military and other
types of public service. The key emphasis is placed on identifying
gaps in the current mechanism of rotation of civil
servants and studying the views of scholars on the modernization
of the institute of rotation. Special attention is paid
to the issues of providing state guarantees to employees
when they are appointed to a position on a rotating basis
due to a change of location. The study of the existing legislation regarding the rotation
system for state civil servants and the review of scientific
papers on this issue allowed the author to develop
a number of recommendations for the modernization of le-
gislation. In particular, it is proposed to set a certain period
of time for filling a civil service position on a rotating basis,
and to expand the scope of state guarantees provided to civil
servants appointed on a rotating basis. The implementation
of these proposals will improve the efficiency of the rotation
of civil servants. |
