With the introduction of the universal payment
code in 2026, legal regulation of QR payment codes was introduced
in Russia for the first time. Previously, regulation was
provided for in technical standards. The new legal provisions
define the universal payment code, identify the entities interacting
with its generation and provision, and define their mutual rights and obligations. The general rules enshrined in legislation
will be detailed in bylaws and documents. Mandatory use
of the universal payment code for retail payments, including settlements
in digital rubles, is provided for. Given that the functions
of generating and issuing universal payment codes are
assigned to National Payment Card System Joint Stock Company
(NSPK JSC), a state monopoly in this area can be considered.
This approach is justified by the need to unify and standardize
the rules governing retail payments. The new rules may become
the basis for further development of legislation regulating money
transfers. In particular, these rules can be used to formulate
legal regulations for other types of QR payment codes that
may be used outside the scope of the Criminal Procedure Code.
It seems appropriate to develop and enshrine in law rules governing
other alternative payment methods. It is necessary to create
a scientific basis for improving legislation in the area of money
transfers. Theoretical research can substantiate the emergence
of a new legal institution within the Russian legal system, as well
as formulate proposals for harmonizing existing legal regulations:
the transfer rules established by the Bank of Russia clearly
require updating to reflect these newly introduced rules. |
