This article examines the platformization of cus
toms administration in the Russian Federation and the Eura
sian Economic Union from the perspective of economic theory
and criminal law. The authors analyze the economic mecha
nisms underlying digital platforms, which facilitate the illicit
trafficking of dual-use goods and technologies. The relevance
of this topic stems from the large-scale digital transforma
tion of the Federal Customs Service of Russia and the simul
taneous increasing complexity of customs crimes committed
in the platform economy. The purpose of the study is to iden
tify the economic effects of the transition to a platform-based
customs administration model and to systematize the crimi
nal law risks arising during this transformation and posing
a threat to national security. The methodological framework is
based on a systems approach, institutional analysis, compara
tive legal research methods, and statistical analysis of customs
law enforcement data. An analysis of the evolution of customs
administration from the automation of individual operations
to the formation of a comprehensive digital platform is conducted.
It is established that the current regulatory framework of the Rus
sian Federation is not fully adapted to the specifics of the digi
tal environment, in which export control entities are becoming
networked, transnational, and anonymous. Contradictions are
identified between the economic efficiency of platform solutions
and the increasing criminal risks associated with smuggling,
customs evasion, and the use of forged documents in for
eign exchange transactions. A classification of criminal risks
in the context of the platformization of customs control is pro
posed. Directions for improving legal regulation and organiza
tional mechanisms for ensuring national security in the sphere
of the state’s foreign economic activity are substantiated. |
