THE PROBLEM OF ENFORCEMENT OF THE RULES OF PUNISHMENT SETTING WITHIN THE NORMS OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

The analysis of the legislatively set definition regarding the criminal punishment has been performed. The criteria of the criminal punishment setting have been analyzed. The attempt to develop the new concept of setting the criminal punishment and the mathematical quantitative equivalents for all crimes has been made, while expressed them in appropriate sanctions of the norms of the Criminal Code of the Russian Federation. It has been proposed to transfer the provisions of part 3 article 60 of the RF CC to part 2 article 60 of the RF CC. The attention has been paid to the necessity to determine the final punishment by means of the algebraic operations with equivalent crimes and individual coefficients.
