PROCEDURAL RIGHTS IN THE MECHANISM OF JUDICIAL PROTECTION OF THE LAND RIGHTS OF CITIZENS AND LEGAL ENTITIES

The article examines the issues associated with implementation of procedural rights in the mechanism to judicial protection of the land rights. The Russian legislation regulating the institution of judicial protection is analyzed, as well as the procedural legislation governing the procedural rights of citizens and legal entities. Peculiarities of the procedural mechanism of the land protection rights implementation in the area of land disputes are determined. The analysis of procedural rules aff ecting the issue of the land rights judicial protection is conducted. The conclusions are made that allow distinguishing between such concepts as implementation of procedural rights in the mechanism of judicial protection and fulfi llment of procedural rights.
