ON THE ISSUE OF THE LEGAL STATUS OF A MENTOR IN LABOR RELATIONS

Annotation:

Today, the mentoring Institute is gaining popularity. Undoubtedly, mentoring is an investment in long-term development for educational organizations, companies, and government institutions. Currently, the topic of mentoring in education is one of the Central ones in the national project “Education„. In this regard, the article analyzes the legal acts regulating the legal status of a mentor in labor relations in the field of education, public service, and business. Based on the analysis of additions and changes that were made to the Federal law “On education in the Russian Federation„ of December 29, 2012, it is concluded that the issues of rights and obligations of mentors in the field of education were not covered. The legal status of a mentor is determined not only by socio-economic changes in the country, but also by the form of interaction between the mentor and the pupil, which has led to the need to consider models of the mentoring Institute. Currently, the concept and types of mentoring for a commercial organization are not fixed by the legislation of the Russian Federation, and there are no regulations on mentoring at the level of labor legislation. It is analyzed that the format of a mentor’s employment relationship depends on the method of applying mentoring technology in the organization and is regulated by articles of the Labor code of the Russian Federation. For example, mentoring may be part of an employee’s job function, in which case the mentor’s remuneration may be included in the salary, or the employee-mentor may be provided with an incentive allowance. Mentoring can also be carried out in conjunction with the establishment of additional payment. The law establishes the procedure for mentoring public civil servants of the RF.
