PRINCIPLES AND FORMS OF LABOR ORGANIZATION OF CONDEMNED IN THE MODERN PRISON SYSTEM

Annotation:

The article analyzes the features of the labor function of convicts serving sentences of imprisonment at the institutions of the penal system of the Russian Federation. Today, labor, as before, takes the most important place among the means of dealing with convicts, however, discussions are increasingly emerging about the lack of legal regulation, starting from the moment the convicts are recruited to work and ending with the end of the employment relationship. The author concludes that the achievement of the goals of re-socialization of convicts is inextricably linked with the activities of correctional institutions to create conditions for the convicts to acquire (restore) professional labor skills and specialties for their subsequent adaptation in society, developing their psychological and moral need to work. At present, the Russian penitentiary system needs to rethink the principles of its construction. At the same time, there is a number of problems in the labor regulation of convicts, the solution of which is the first step to reforming the Russian penal system. The author used the comparative legal, comparative historical method, methods of analysis and synthesis. The article discusses the principles of organization of the labor of convicts, enshrined in the national and international legislation, as well as the specifics of their implementation in the context of achieving the goals of the criminal executive policy. The specifics of organization of the labor of persons sentenced to imprisonment in Russian and foreign penitentiary institutions are revealed. The features of attracting private companies to organization of labor of prisoners sentenced to deprivation of liberty, the execution of certain works by convicts in specially equipped workshops outside the correctional facility, the employment of convicts on specially created farms and other innovations used in foreign prison systems are revealed.
