THE WAY OF COMMITTING “SUICIDAL” CRIMES AS THEIR COMPOSITE SIGN

The social danger of “suicidal” criminal acts lies not only in the fact that they are aimed at social relations in the field of life protection, but also are characterized by immorality, insidiousness, and a cynical attitude toward the dignity and state of mind of the victim. The paper considers some features of the methods of committing crimes that are associated with suicide. The author substantiates the provision that in Art. 110, 110.1 and 110.2 of the Criminal Code of the Russian Federation, the fundamental constituent feature that contributes to the correct qualification of the crimes specified in these norms and their delimitation from each other is the method. The paper presents an analysis of all methods of committing crimes specified in Art. 110, 110.1 and 110.2 of the Criminal Code of the Russian Federation. The study allowed the author to draw conclusions about the need to formally fix the list of threats for Part 1 of Art. 110 of the Criminal Code of the Russian Federation, as well as indications of their nature in order to delimit from blackmail, specified in Part 1 of Art. 110.1 of the Criminal Code of the Russian Federation and definitions of “ill-treatment” and “systematic humiliation of human dignity”. In addition, the author sees the need to change the wording of the qualifying feature specified in paragraph “e” of Part 2 of Art. 110, paragraph “d” of Part 3 of Art. 110.1, Part 2 of Art. 110.2 of the Criminal Code of the Russian Federation, to the phrase: “in a publicly demonstrated form”. The study of Part 1 and Part 2 of Art. 110.1 of the Criminal Code of the Russian Federation showed their discrepancy in terms of the degree of public danger in relation to each other. In addition, the author considers reasonable the addition of Part 1 of Article 110.2 of the Criminal Code of the Russian Federation with an indication of publicity in order to distinguish the mentioned in this norm act from the inducement to suicide
