THE GARDEN, THE COUNTRY GROUND AREA, THE SITE FOR CROPS: CONCEPT AND DISTINCTIONS IN A LEGAL REGIME

In the article the author gives the determinations of garden, summer-resort and garden section, gives the characteristic of the legal regulation of acquisition of the rights and the use of the said land plots. The attention is focused on the distinguishing features, inherent in the legal regime of each of the specified land plots. The legal regime of summer-resort, garden, and garden sections is determined on the basis of their belonging to the one or the other category and the permitted use in accordance with the zoning of territories. I.e., the limits of the competences of the right-holders of such plots depend on the ultimate purpose of the earth (which is determined depending on the category of the earth), and they can be located either within the limits of the earth of the populated areas or the earth of agricultural designation.
