THE ISSUE OF PARTICIPATION OF OMBUDSMEN FOR CHILDREN IN THE RUSSIAN FEDERATION IN THE ACTIVITIES FOR ENFORCEMENT OF MINORS’ RIGHTS IN THE AREA OF MIGRATION

The grandiose social changes of the second half of the 20th century are associated with the beginning of transition from the era of individual societies to the era of super-societies. The processes of globalization and international integration are inevitably accompanied by processes of international migration of people. The practice of state bodies and scientific data confirm that children are involved in migration processes. It is obvious that minors, due to their age and lack of life experience, need special protection from the side of the government. Children affected by migration processes are particularly vulnerable, as they have specific legal problems in terms of exercising their fundamental rights (to free travel, choice of place of stay or residence, to health and medical care, to education, to housing, and social security). The role of non-judicial human rights protection bodies, such as the prosecutor’s office and ombudsmen of general and specialized competence, is increasing in the field of human rights protection. The latter include ombudsmen for children. Over the past decade, the current institution of ombudsmen for children has been formed in the Russian Federation. The practice of ombudsmen for children in the Russian Federation indicates that they are paying attention to enforcement of the rights of children with migration experience. This article substantiates the activities of ombudsmen for children to enforce the rights of minors in the field of migration, as well as suggests possible changes to the current legislation on ombudsmen for children in the interests of children with foreign citizenship.
