WAYS OF PROTECTION OF LABOR RIGHTS UNDER CONDITIONS OF DIGITAL ECONOMY AND THEIR IMPLEMENTATION

The ongoing legal experiments on introduction of electronic personnel workflow show reduction in the cost of registration of the labor process. However, it is not yet known how this will affect the effectiveness of protecting labor rights. The author of this article sets the goal: to study implementation of existing methods of protection in the digitalization of labor relations. In the research process, the method of legal analysis and the formal legal method were used. The main conclusion: a detailed study of ways to protect labor rights in the context of digitalization of labor relations shows that digitalization will contribute to the quality of their implementation, the justification of the choice in certain situations, and the ease of application (electronic form). The use of “numbers” will have a significant impact on identification of evidence in the process of resolving labor disputes. Results: considering the self-defense as a way of protecting labor rights, the author notes the need to provide the employee with the right to use electronic signatures in labor activities, including for effective self-defense of labor rights. An analysis of implementation of such method as the protection of the labor rights of workers by the federal labor inspectorate shows that this method will remove the administrative burden on employers, shorten the recovery period of violated labor rights of workers, but are unlikely to significantly affect the effectiveness of protection of labor rights. A similar situation arises with protection of labor rights and interests by trade unions, as well as the judicial protection of this category of rights. The study can serve as the basis for further study of implementation of existing methods of protecting labor rights in modern economic conditions, as well as identifying new ways to effectively protect the labor rights of workers and employers.
