Annotation:

The article covers principles and criteria of assessment applicable for entrepreneurs as provided by the modern antitrust law. The author analyses both criteria set forth in laws and statutory decrees, as well as by jurisprudence. The article also covers systematization of the criteria by various grounds including subject and object, special and universal criteria within the frames of two basic principles: rule of reason i. e. assessment of the reasonableness and per se illegal. The author states that the current criteria are insufficient that prevents achieving their goal, which is to become the benchmark for self-definition of the legality of the operation.
