Annotation:

The number of applications for bankruptcy of citizens since the advent of this procedure in the Russian law is growing every year. The absence of such an opportunity in Russia created numerous problems for citizens who were not able to fully or partially fulfill their debt obligations. Currently, the legislation on insolvency (bankruptcy) is one of the most dynamically developing systems of legal regulation. Despite the relevance of this institution, the provisions on the bankruptcy of individuals are imperfect both for the debtor and for creditors, society and require improvements. The purpose of the article is to analyze the study of the characteristics of the institution of bankruptcy of a citizen under the Russian law and identify problems of legal regulation. The structure of the study is determined by the purpose, objectives and includes an introduction, the main part, conclusions, bibliography. In the main part of the article, the legislation governing the insolvency (bankruptcy) procedure of a citizen is analyzed, some procedural issues are disclosed. In addition, the problems of improving the arbitration management mechanism, the rights and obligations of a citizen-debtor are considered, the advantages and disadvantages of the bill in terms of extrajudicial bankruptcy of a citizen are revealed. The author draws attention to the need to eliminate some problems by improving the regulatory framework.
