The Constitution of the Russian Federation establishes the right to health care and medical assistance, which is provided free of charge. One of the main sources of funding for the provision of medical care is the funds of mandatory health insurance. The use of these funds currently takes place in the absence of a sustainable model for the distribution of health care costs, which leads to insufficient funding of certain activities and areas and, ultimately, to a decrease in the quality of free medical care in Russia. The article considers the problems of low competition between medical organizations of different forms of ownership, inefficiency in the organization of funding for free medical care, legal uncertainty in the implementation of payment for medical care provided to insured persons free of charge outside the subject of the Russian Federation, in which they reside. The author analyzes the results of the audit of the Accounts Chamber of the Russian Federation on the effectiveness of the system of compulsory health insurance in the Russian Federation, as well as materials of judicial practice on the dispute about the recovery of debt for medical care provided to insured persons outside the subject of the Russian Federation, in which the policy of compulsory health insurance was issued. Possible options for solving the identified problems are proposed: increasing the total minimum required share of medical organizations of the private health care system, which participate in the implementation of territorial programs of compulsory health insurance, as well as amendments to existing regulations in order to reduce administrative barriers to obtain free medical care by the insured.
