COMPENSATION OF THE MORAL HARM CAUSED BY ILLEGAL CONVICTION AT THE EXPENSE OF THE TREASURE OF THE RUSSIAN FEDERATION

The article is devoted to the compensation of moral harm as a method of defense of the subjective civil rights and lawful interests of citizens as a result of illegal conviction, prosecution to criminal responsibility, illegal arrest or written undertaking not to leave a place. The content of Article 1070 of the Civil Code and its implementation on examples of the court practice in Samara region has been revealed. The norms of the Civil and the Budget legislations of the Russian Federation have been analyzed in the article. The current legislation and different viewpoints of the scientists on the said issue have been analyzed. The author has made some proposals.
