About the prospects of legal regulation of building on the land plot belonging to the other: leasehold estate or superficies

The article analyzes the current civil legislation regulating procedure of granting land plots for construction of buildings and structures on them, as well as the established practice of application of these rules of law. The study’s authors speculate on the prospects of legal regulation and the development of new effective forms of the land use for construction of residential houses. Civil and legal structure of the rights of development is subject to critical reevaluation as one of the types of the limited real rights proposed by the bill for amendment of the RF Civil Code. The need for revision of existing legal regulators of construction on someone else’s land plot is highlighted.
