This article covers the main aspects of the modern understanding of a special kind of real estate — incomplete construction facility; the main features of such law entity are highlighted. Based on a critical analysis of the civil law and various theoretical developments, the author formulates his own definition of this concept and proposes to add it to the legislation. Judicial acts, which define the content of the concept «incomplete construction facility» are analyzed; their value for development of modern ideas about this legal institution is highlighted. Legal essence of incomplete construction facility is emphasized as the type of new real estate having modified nature, the right for which occurs upon the state registration. |
