The role of the decisions of the Constitutional Court of the Russian Federation in determining the real estate legal status

| Annotation: | The article reviews the decisions of the Constitutional Court of the Russian Federation on the clarification of the legal regime of the real estate. Analyzing these examples, the author notes that the Constitutional Court giving the interpretation of the provisions of the Federal laws regarding regulation of various aspects of the legal regime of the real estate, has constructed in fact the new regulations of the law. The article highlighted and analyzed in detail three most interesting aspects of the lawmaking of the Constitutional Court: redistribution of movable property and real estate between the public authorities; clarification of the legal regime of the land plots as the objects of real estate; interpretation of the regulations dedicated to the issues of judicial protection of the property rights. | ||
