Tо the issue of the system and structure of the state defense within the frame of the constitutional law of the Russian Federation

This work examines the problem of definition, distinguishing the system and structure of defense, the value of distinguishing the system and structure of defense, which is necessary for determination of the position of defense in the state legal system; concepts of national security and defense are differentiated. Differences of such similar notions as national security, military security and defense are presented. Analysis of the constitutional legislation of the Russian Federation, as well as of foreign countries is fulfilled for the purpose of the most complete and exact resolution of the set objectives. The option of distinguishing the system and structure of defense within the frame of state legal system based on the system and structure of national security as the institute of constitutional law is proposed.
